John Harburd 1723

In the Name of God Amen I John Harburd of Browneswood Green in the parish of Cosgrave in the County of Northampton Laceman being Weake and decaying in body but of sound and perfect mind and memory praise be therefore given to Almighty God for the same Doe make ordain Constitute and appoint This my present Last Will and Testament in manner and form following that is to say First and principally I Commend my soul into the hands of Almighty God my Creator hopeing through the Merritts death And passion of my Lord and Savior Jesus Christ to have full and free pardon and remission of all my Sins and to Inheritt Everlasting Life And my Body I Committ to the Earth to be decently buried at the discretion of my Executrix hereinafter named and as touching the dispersion of all such Temporal Estate as it hath pleased Almighty God to bestow upon me in this Transitory World I give devise and dispose thereof as followeth First I Will that all my debts that I owe in right or Conscience to any person or persons whatsoever and my Funerall Charges shall be paid and discharged by my Executrix Item I give and devise unto Mary my Loving Wife and to her assignes all that my Cottage Tenement or dwelling house with the appurtenances scituate standing lying and being in Potterspury in the said County of Northampton in the Occupation of one William Saxbey for and during the Term of her natural Life if she continue unmarried and keep herself Sole and a Widow and immediately from and after her decease I Give and devise the same Cottage and Premises with their Appurtenances unto my son William Harburd and to his heires and assignes for ever And if my Said Wife should happen to marry again as aforesaid then so soon as my son William shall attain to one and twenty years of Age Then I give and devise the said Cottage with all the appurtenances unto my said son William Harburd and to his heirs and assignes for ever and my Will and meaning is that if my said Son shall die before such age as aforesaid and without issue of his Body Lawfully begotten then I give and devise the same Cottage with the appurtenances unto my Daughter Mary Harburd and for her heires and assignes for ever and if her mother happen to marry again as aforesaid then so soon as my said daughter Mary shall attain to Twenty years of Age I doe then hereby give and devise the same Cottage with the appurtenances unto my said daughter Mary Harburd and to her heirs and assignes for ever Item I doe hereby give and devise that my Close of pasture or enclosed ground called Simpkins Stockings with the Trees Hedges Ditches rights Members and appurtenances thereto unto belonging situate Lying and being within the Parish of Cosgrave aforesaid and now in my own Occupation Land lying along by Brownswood adjoining thereunto on the North part and an Assart Ground of one Richard Scrivener Lying and adjoining next thereunto Southward unto the said Mary my Loving Wife and to her Assignes for ever and during the Terme of her Natural Life if she continue unmarried and keepe herself sole and a Widow as aforesaid and immediately from and after her decease the same Close with the appurtenances unto my said Daughter Mary Harburd and to her heires and assignes for ever and if my said Wife shall happen to marry again as aforesaid Then so soon as my Daughter Mary shall attain to Twenty years of Age I Doe Hereby then give and devise the same Close with the appurtenances unto my said Daughter Mary Harburd and to her heires and assignes for ever And my Will and meaning is that if my said Daughter shall die before she attain to the age of Twenty years as aforesaid and without issue of her Body Lawfully begotten Then I Doe hereby give and devise the same  Close with the appurtenances unto my Son William Harburd and to his heires and assignes for ever And if his said mother happen to marry again as aforesaid then so soon as my said son William shall attain to one and Twenty years of age as aforesaid I Doe then hereby give and devise the same Close as aforesaid called Simpkins Stockins with the appurtenances unto my said Son William Harburd and to his heirs and assignes for ever Item my Will and meaning is and desire that my said son William Should be admitted Tenant to all that my Cottage and Three Tenements being four dwelling houses with the Yards backsides and appurtenances Thereunto belonging and adjoining scituate standing and being on the West side of Stony Stratford in the parish of Calverton in the County of Bucks and belonging to the Mannor of Calverton being Copy Hold of Inheritance after the decease of the said Mary my Wife To the use of my said son and of his heirs and assignes for ever according to the Custom of the said Mannor of Calverton and if my said son William should happen to dye without Issue of his Body Lawfully begotten then my further Will and meaning is and desire that my said Daughter Mary should be admitted Tenant to all them the said Cottage and Three Tenements with the appurtenances thereunto belonging and adjoining scituate standing and being on the West side of Stony Stratford aforesaid and belonging to the Mannor of Calverton aforesaid and being Copy hold of Inheritance as aforesaid after the decease of my said Wife to the use of my said Daughter Mary and of her heires and assignes for ever according to the Custom of the said Mannor of Calverton Item O Doe hereby give and Bequeath unto my said son William Harburd the summe of Ten Pounds of Lawfull money of England to be paid him by his mother my Executrix to put him out an Apprentice to some Trade that he shall Like and approve of or into some other way of business for and towards a livelyhood as by his said Mother shall think most proper fit and Expedient Item I Doe hereby Give and bequeath unto my Cosen Mary Moretimer the summe of Forty Shillings of Lawfull money of England to be paid her by my Executrix Item I Do hereby make ordain and appoint my Brother Thomas Hart of Silverstone in the said County of Northampton Lacebyer and John Bayley of Pookesly Green in the parish of Passenham in the County of Northampton yeoman Overseers of this my Last Will and Testament and if my Wife shall happen to die before my said son and daughter shall attain to years of majority I Doe then request and desire my said Overseers to see my said Children bred up in a Decent and hansome manner according to their Degree and ability And I Doe hereby Inpower my said Overseers to let Lett and devise all my reale Estate consisting of five dwelling houses and a Close of pasture ground with their appurtenances as aforesaid and to receive the rents Issues and profits of the same from time to time to and for the use of my said son and Daughter respectively according to the Termes and intent and meaning of this my Will as aforesaid and to be accountable for the same to my Son at his attainment of One and Twenty years of Age and to my Daughter at her attainment of Twenty years of age as aforesaid all the rest and residue of my personal Estate Goods Cattell Chattells Bills Bonds Mortages Debts dues personalities or Estate personal whatsoever or Wheresoever herein devise and Begiveath unto the said Mary my very Loving Wife for ever whom I Doe hereby make constitute and appoint full and sole Executrix of this my present Last Will And Testament and I Doe hereby revoke Disannull and make void all former Wills and Testaments by me heretofore made In Witness whereof the said John Harburd to this my present Last Will and Testament being contained in one skin of parchment have hereunto sett my hand and seal the Eighteenth day of March in the Third year of the Reign of our Sovraign Lady Ann by the grace of God of England Scotland France and Ireland
