Joshua Thorne 1833

In the Name of God Amen I  Joshua Thorne of Old Stratford in the parish of Cosgrove in the County of Northampton Gentleman to right publish and declare this my last will and testament in manner and form following that is to say I will and direct that all my just debts funeral and testamentary expenses be fully paid by my Executrix and Executors here in after named as soon as conveniently may be after my decease I give and bequeath all my household furniture plate linen books wearing apparel and all other my effects and also all debts sum and sums of money securities for money and all other my personal estate whatsoever and wheresoever subject to the payment thereof all my just debts as above unto my dear Wife Kitty late Kitty Robinson two and for her own use and benefit also I give and devise all and every my messuages lands tenements hereditaments and real estate whatsoever and wheresoever with their appurtenances unto my son James Thorne a Captain in the Royal Navy my son George Edward Thorne of Stony Stratford Draper and his son John Thorne Chemist and Druggist Upon Trust to permit and suffer my said Wife Kitty to receive and take the rents issues and profits of my said real estates for and during the term of her natural life and two and for her own benefit and disposal and from and after the decease Upon further Trust that they my sons trustees or the survivor of them or the heires of such survivor do or shall sell and dispose of the same estates together or in parcels by public auction or private contract as to the them or him shall seen most expedient for the best prices as can be procured for the same and I direct that the receipt or receipts of my said trustees and the survivors or survivor of them or the heirs executors and administrators of such survivors for the money arising from any such sale or sales shall be good discharges for the same or so much as shall be in such receipts as expressed to be received and that’s the purchasers of the same estates or any part there of his her or their heirs executors administrators or assigns shall not afterwards be answerable or accountable for the same or for any loss miss application all nonapplication thereof or any part thereof and as for the money arising from such sale or sales as aforesaid I will and direct that the same be paid undisposed of in the manner hereinafter mentioned that is to say and I give and bequeath unto my daughter Anna Maria Wife of Mr. Matthias March one eighth part unto my son James Thorne one eighth for part unto my son George Edwards Thorne one eight part unto my son is Joshua Henry Thorne one eighth part unto my son John Thorne one eighth part unto my daughter Sarah Georgiana Thorne two eighth parts unto Richard Robinson son of my Wife Kitty by her former husband of the other eighth part and my most sincere desire that my son George Edwards or my son John takes the above Richard their Brother unto his home after the decease of his mother or otherwise see that he is comfortable provided for and for which purpose my Will is that the share belonging to the son Richard be paid unto my sons son George Edward first or my son John or to their of them agreeing to take care of him during his natural life its being very probable that he will have other provision from his Uncle M Robinson who has provided so to do in his letter to me and I do hereby declare that should any of my children died in a lifetime of my said Wife my will is that their share the equally divided among my other children provided they left no child or children lawfully begotten of their bodies but should they have and be entitled to such share as their deceased parent would have been entitled to under this my will if living such share to be paid to such issue when they shall severally attain the age of twenty one Years the interest of such share until they come of age to go towards bringing them up and my will is that my trustees showed they had deem it is advisable may withhold the sale of my said estate for any indefinite time they may think proper taken care to pay the proportionate share of rents according to the above specified shares to each and every one And Lastly I hereby nominate constitute and appoint my said Wife Kitty and also my said son James and my son George Edward joint Executrix Executors of this my will hereby revoking and making void all former Wills by me at any time heretofore made and declare this to be my last Will and Testament In Witness whereof I the said Joshua Thorne have to this my last Will and Testament set my hand and seal this twentieth of April in the Year of our Lord one thousand eight hundred and thirty two and in the seventy second years of my age I will that my trustees shall have all necessary expenses paid to them Joshua Thorne Signed Sealed and Published by the said Testator Joshua Thorne as his last Will in the presence of us in his presence and at his request and in the presence of each other have subscribed our Names as witnesses thereto A Capes H S Kettle Maria Kettle

This Codicil to my last Will and Testament I have added in consideration of the uncertainty and instability of Merchants and recollecting that my daughter Anna Maria March has not received from me the same proportion as her brothers my will is that at the decease of my dear Wife Kitty and when the dividend of my real estate into eight shares if that in addition to the share willed to her that the fifty pounds my son James owed to me when he left Old Stratford in January 1831 I give and bequeath to my said daughter Anna Maria and I likewise request that my sons George Edward Joshua Henry and John to make up by an equal some of£16 13s 4d each one other fifty pounds so that my daughter Anna Maria may have one hundred pounds above her share of the eight part of my real estate bequeath to her in my will to which this is a.ueseed it is by the blessing of God my four sons are established in affair and creditable line of life for which I pray the Almighty God for they may long continue in the same and I feel most happy in believing they will comply with my sincere request what assistance may in their power to each of their sisters Anna Maria and Sarah Georgianna according as they stand in need of the same at any future period to the above writing I have this 12th August 1832 set my hand Joshua Thorne

Prerogative In the Goods of Joshua Thorne deceased

Appeared Personally Matthew Willison of Old Stratford in the Parish of Cosgrove Northamptonshire and George Dickens of Old Stratford in the county of Northampton Gentleman and made oath that they knew and were well acquainted with Joshua Thorne late of Old Stratford in the Parish of Cosgrove in the county of Northampton Gentleman deceased and also with his manner and an character of handwriting having frequently seen him write and write and subscribe his name to writings and having now or with care and attention viewed and inspected the paper writing here to annexed by preporting  to be and contain a Codicil beginning thus “This Codicil to my last Will and Testament and I have added in consideration of V maintenance and instability of Merchants” ending thus “according as they stand in need of the same at some future period” and verse dated and subscribed “to the above writing I have is 12th August 1832 set my hand Joshua Thorne they these desponents do dispose and say they then do verily and in their consciences believe the whole body series and contents of the said paper writing beginning ending dated and described as aforesaid to be the proper handwriting and subscription of the said Joshua Thorne deceased Matthew Willison George Dickens On the 23rd day of February 1833 the Matthew Willison and George Dickins were duly sworn to the truth of this affidavit by virtue of the annexed commission before me C. Kiplins LLB Vicar of Stony Stratford Bucks the adjoining Parish to Cosgrove
